1. Eligibility: The Georgia Lottery Virtual Yearbook Promotion (the "Promotion") is open to all legal residents of the state of Georgia who are 18 years of age or older and are Georgia HOPE Scholarship recipients or Parents or legal guardians of Georgia HOPE Scholarship or Pre-K current or former recipients who enter in accordance with Section 2 below. Employees of The Georgia Lottery Corporation ("Sponsor"), BBDO Atlanta, WSB-TV, Georgia Lottery Draw Stations and their agents, advertising/promotional agencies, and their immediate family members living in the same household are not eligible. HOPE or Pre-K recipients, or Parents or legal guardians of HOPE or Pre-K recipients are limited to one entry per student. No purchase necessary. Void outside Georgia and where prohibited by law. By participating, Entrants agree to these Official Rules and to the decisions of Sponsor, which will be final and binding in all respects.
2. How to Enter: Commencing July 15, 2008 at 10:00 a.m. E.D.T. and continuing through September 15, 2008 at 4:59 p.m., entrants may enter the Promotion through the Georgia Lottery website at www.galottery.com. Click on the promotion link and complete all required registration entry information and upload a photo(s) in one of the following four categories: Pre-K Photo, High School Photo, College Photo or Graduation Photo. The Entry must include or feature a positive reference about your experience as a Georgia HOPE Scholarship recipient or the Parent or legal guardian of a Georgia HOPE Scholarship or Pre-K recipient. The person uploading the Entry will be deemed the entrant (the "Entrant").
3. Entry Conditions: All entries submitted will be included in the Georgia Lottery Virtual Yearbook if all the entry conditions of the official rules are met. All entries received become the sole property of the Sponsor and will not be acknowledged or returned.
Any Entry Material or portion thereof that is, in the Sponsor's sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, marks that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Therefore, clothing worn in the picture should not contain any visible logos, drawings, cartoons, phrases, trademarks or other third-party materials. Entrants may not copy or otherwise plagiarize the Entry Materials from any source. Sponsor has the sole discretion to determine whether a photo qualifies as an Entry. All photos must belong to the Entrants.
Entrants and winners acknowledge and agree that their Entries become the property of the Sponsor, which thereby has the right to edit, adapt, modify, reproduce, promote and otherwise use Entries in any way it sees fit. Entries must be in keeping with Sponsor's image and may not be offensive, as determined by Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights. In such an event, the Entry will not be posted online and will be disqualified from the Promotion. Any Entry not in compliance with the above and does not meet the Websites' requirements will be disqualified. By entering, you agree to waive any rights you may have to the Entry Materials submitted.
All entrants grant to Sponsor and its successors, licensees and assigns, the irrevocable right, but not the obligation, with or without the entrant’s knowledge, to film, tape and/or photograph, record, exhibit, edit and otherwise use the entrant’s appearance, name, likeness sounds and biographical data on or in connection with the Virtual Yearbook Promotion in any matter in Sponsor's sole election and discretion, which use shall not entitle the entrant to receive any compensation whatsoever. All entrants agree that Sponsor is the sole owner of all results and proceeds of such film, tape, photography and/or recording of the entrant’s appearance thereon, with the right for Sponsor and its successors, assigns, and licensees, forever and throughout the universe, to use the same and any portion thereof in any and all media, whether now known or hereafter devised, including, without limitation, motion pictures, television and publishing, and in connection with the advertising, sale, promotion, marketing, merchandising (including lottery tickets), distribution, publicizing and all other types of exploitation of the Promotion or any part thereof, or in any manner whatsoever. Sponsor shall also have the unrestricted right to edit the content and text of the Promotion in any manner or form.
4. Prize Description/Approximate Retail Values (ARV): One (1) Grand Prize and fifteen (15) First Prizes shall be awarded by random drawing:
A. Grand Prize: Georgia Aquarium VIP Experience for 15 (Approximate Retail Value: $1800). Prize will be awarded as a Behind the Scenes Tour of the Georgia Aquarium, admission to Deepo’s Undersea 3D Wondershow and Lunch for 15.
B. Fifteen (15) First Prizes (Approximate Retailer Value: $100): Fifteen (15) prizes will be awarded as a $100 Gift Certificate from a national book retailer.
No cash substitutes for prizes are available, except by Sponsor, which reserves the right, in its sole discretion, to substitute different prizes of comparable value. Sponsor’s decisions shall be final and conclusive in all matters relating to the Promotion. The Grand Prize Winner will be required to provide their social security number for IRS reporting. Applicable local, state, and federal taxes and any customs charges or tariffs on prizes are the sole responsibility of and must be paid by the winner(s).
5. Grand Prize Drawing: One (1) entry will be randomly selected from all eligible entries received. The Grand Prize random drawing will be conducted on or about September 15, 2008 by Sponsor. Entries received after the deadline for the drawing will not be eligible for the grand prize drawing but will be included in the Virtual Yearbook. Odds of winning depend upon the total number of eligible entries received.
A. First Prize Drawing: Fifteen (15) entries will be randomly selected from all eligible entries received. The First Prize random drawing will be conducted on or about September 15, 2008 by Sponsor. Entries received after the deadline for the drawing will not be eligible for the first prize drawing but will be included in the Virtual Yearbook. Odds of winning depend upon the total number of eligible entries received.
6. Winner Notification: Telephone contact will be attempted for the potential Grand Prize winner. In addition, all potential winners will be notified by U.S. mail and/or express mail at the street address provided upon entry into the Promotion. If winner notification or prize is returned as undeliverable, without a forwarding address, or winner does not return winner documentation as required hereunder, prize will be forfeited. Unclaimed prizes will be awarded to an alternate.
7. Affidavit of Eligibility and Liability/Publicity Release: Except where prohibited by law, the winner will be required to complete and sign a Winner's Affidavit and Release and return it within 14 days of prize notification or prize will be forfeited. Proof of sending will not be deemed to be proof of receipt by Sponsor. By submitting an entry, a winner agrees to allow use of his or her name, in full or in part, for any and all purposes in any and all media now known or hereinafter developed without territorial or time limitations and without compensation, including, but not limited to for promotional and advertising purposes.
8. General Terms & Conditions: By participating in the Promotion, all entrants agree to the Georgia Lottery “Virtual Yearbook” Official Rules and the decisions of the Georgia Lottery, whose decisions shall be final in all respects and legally binding in all matters related to this Promotion. All entrants and winners agree to release, discharge, hold harmless and indemnify Sponsor, BBDO Atlanta, and WSB-TV against any and all liability whatsoever for any injuries, losses, harm, damage (including but not limited to property damage, personal injury and/or death), claims, actions, costs and expenses (including without limitation, all attorney’s fees and court costs) arising directly or indirectly from or in connection with his/her participation in the Promotion, acceptance, possession or use/misuse of the prize or participation in any prize-related activity, including but not limited to any travel related thereto or any goods/services provided in connection with any prize. Participant further acknowledges that Sponsor is in no manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. Acceptance of prize shall further constitute and signify the winner’s agreement and consent that Sponsor may use the winner’s name, likeness and/or prize and biographical information worldwide for promotion purposes without limitation and without further compensation, except where prohibited. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of the Promotion, including without limitation, barring and disqualifying participants who do not comply with these Official Rules. By entering, participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws and regulations of the State of Georgia, without giving effect to any choice of law or conflict of law rules. By entering, participants consent to the jurisdiction and venue of the federal, state and local courts located in Atlanta, Georgia.

11. Decisions of the President/CEO: In the event of any situation not provided for in these Georgia Lottery “Georgia Lottery Virtual Yearbook” Promotion Official Rules or any conflict between any provisions of these rules, the decision of the President/CEO of Georgia Lottery Corporation, or her designee, shall be final and binding.
